General Terms And Conditions

1. General Provisions

1.1 Customers within the meaning of these General Terms and Conditions (GTC) include both consumers and businesses.

1.2 A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

2. Offer and Conclusion of Contract

2.1 eBay

2.1.1 Contracts are concluded in accordance with § 6 of the eBay Terms and Conditions. (The complete eBay Terms and Conditions can be viewed in the footer of the eBay homepage.)

2.1.2 The technical steps for auctions, “Buy It Now,” shopping cart, and “Make an Offer” are described in the respective eBay instructions.

2.1.3 Before submitting a binding declaration, the customer can review and correct their entries using the “Back” function of their browser or by cancelling the process.

2.2 Online Shop

The products listed in the online shop do not constitute binding offers but rather an invitation to customers to submit a binding offer by placing an order.

By submitting the order via the shopping cart, the customer makes a binding offer. The seller will promptly confirm receipt of the order by email. The purchase contract is concluded once we explicitly accept the order in text form or by dispatching the goods. We are entitled to accept the customer’s offer within two business days after receipt of the order.

3. Prices and Shipping Costs

All prices are total prices in euros including statutory VAT plus shipping costs and, where applicable, surcharges for bulky goods. The applicable shipping costs are shown in the respective offer.

4. Retention of Title

The delivered goods remain our property until payment has been made in full.

5. Payment, Delivery, Delivery Restrictions, Transfer of Risk

5.1 The available payment methods are listed in the shop. Delivery is subject to the shipping costs specified in the offer. Any delivery restrictions are indicated with the product.

5.2 For consumers, we bear the risk of shipping in all cases. For businesses, the risk passes to the customer once the goods are handed over to the logistics provider.

6. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal. Businesses (§ 14 BGB) do not have a right of withdrawal.

Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement in text form (e.g., letter or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send the notice of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day we received your withdrawal notice. The refund will be made using the same payment method you used for the original transaction, unless expressly agreed otherwise.

We may withhold the refund until we have received the goods back or you have provided proof of having returned the goods, whichever is earlier.

You must return the goods to us within 14 days from the day on which you notify us of the withdrawal. You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

7. Notes on Returns

Please avoid damage and send the goods back in their original packaging if possible. This is not a prerequisite for exercising your right of withdrawal.

8. Compensation for Value

In the event of withdrawal, you may be required to compensate us for any loss in value if the loss is due to handling the goods in a way that was not necessary to establish their condition, characteristics, and functioning.

9. Liability for Defects, Warranty, Liability

All goods are subject to statutory liability for defects.

• For used goods, the warranty period may be reduced to 12 months.
• Claims for damages remain unaffected.
• Any guarantees do not restrict statutory rights.

10. Consumer Information in Distance Contracts

10.1 We are not subject to any special codes of conduct beyond these GTC.
10.2 The essential characteristics of the goods are described in the product descriptions. The contract language is German.
10.3 Complaints and warranty claims can be addressed to the contact details provided in the legal notice.
10.4 The ordering process is explained in the online shop.
10.5 Contract text storage on eBay: stored by eBay for 90 days.
10.6 Contract text storage in the shop: we send you an order confirmation by email including GTC and withdrawal policy.

11. Final Provisions

11.1 German law applies. For consumers, mandatory provisions of the law of the country in which the consumer has their habitual residence remain unaffected. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
11.2 If any provision is invalid, the remainder of the contract remains effective.

Warranty Conditions

If a warranty is indicated in the product description, we – 4 Wheel Parts GmbH – are your contractual partner.

• The warranty covers material and manufacturing defects.
• In the event of a warranty claim, please send us the goods with proof of purchase and a description of the problem.
