General Terms and Conditions
These General Terms and Conditions apply to orders placed via the online shop of 4 Wheel Parts GmbH and, where applicable, to our offers on sales platforms such as eBay.
They regulate, in particular, conclusion of contract, prices, payment, delivery, minimum order value, retention of title, right of withdrawal, statutory liability for defects, warranty conditions and further consumer information.
Important note on withdrawal, returns and minimum order value:
The statutory right of withdrawal applies exclusively to consumers within the meaning of Section 13 of the German Civil Code (BGB). Entrepreneurs / business customers within the meaning of Section 14 BGB do not have a statutory right of withdrawal. Any return of goods ordered by entrepreneurs or business customers requires our prior express approval and is a voluntary goodwill service.
The minimum order value is 25.00 EUR goods value, unless otherwise stated in the online shop.

1. Scope and Contractual Partner
1.1 These General Terms and Conditions apply to all contracts concluded by customers with 4 Wheel Parts GmbH via our online shop or via sales platforms such as eBay.

1.2 Customers within the meaning of these Terms and Conditions include both consumers and entrepreneurs / business customers.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
1.4 An entrepreneur / business customer is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Offer and Conclusion of Contract
2.1 Conclusion of Contract in the Online Shop
2.1.1 The products displayed in the online shop do not constitute legally binding offers, but an invitation to the customer to place an order.
2.1.2 The customer may initially place products in the shopping cart without obligation. Before submitting the order, the customer may review and correct their entries at any time.
2.1.3 By clicking the order button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
2.1.4 After receipt of the order, the customer receives an automatic confirmation of receipt by email. This confirmation of receipt does not yet constitute acceptance of the purchase offer unless acceptance is expressly declared therein.
2.1.5 The purchase contract is concluded as soon as we expressly accept the order in text form, send a shipping confirmation or dispatch the goods. We are entitled to accept the customer's offer within two business days after receipt of the order.
2.2 Conclusion of Contract via eBay
2.2.1 Where we offer goods via eBay, the conclusion of contract is governed by the applicable eBay Terms and Conditions and the respective offer formats provided there.
2.2.2 The technical steps for auctions, Buy It Now, shopping cart functions, Make an Offer or other offer formats are described in the respective instructions and functions provided by eBay.
2.2.3 Before submitting a binding declaration, the customer may review and correct their entries using the functions provided by eBay.

3. Prices, Shipping Costs and Minimum Order Value
3.1 All prices are total prices in euros including the applicable statutory VAT, plus shipping costs, surcharges for bulky goods or freight charges where applicable.
3.2 The applicable shipping costs are displayed in the offer, in the shopping cart or during checkout.
3.3 For large, heavy or bulky items, for example bumpers, suspension kits, wheels, body parts, soft tops, hardtop components or other freight goods, additional shipping costs may apply.
3.4 The minimum order value is 25.00 EUR goods value. Shipping costs, surcharges for bulky goods or freight charges are not included when calculating the minimum order value, unless otherwise stated in the online shop.
3.5 Orders below the minimum order value may not be completed in the online shop or may only be accepted by separate agreement.
Important: The final shipping costs are calculated in the shopping cart or during checkout. This is particularly relevant for heavy, bulky or large-volume items. The minimum order value is 25.00 EUR goods value.
4. Payment
4.1 The customer may use the payment methods indicated in the online shop or on the respective sales platform.
4.2 Depending on availability, the following payment methods may be offered in particular:
PayPal
Payment via PayPal, if available during checkout.
Credit Card
Payment by credit card, if offered.
Prepayment
The order will be processed after receipt of payment.
Google Pay
Payment via Google Pay, if available.
Purchase on Invoice
Purchase on invoice, if offered by the payment provider.
Other Payment Methods
Depending on checkout and payment provider availability.
4.3 In the case of prepayment, processing of the order begins after receipt of payment.
4.4 If a payment service provider is selected, the terms and conditions of the respective payment service provider also apply.
5. Delivery, Delivery Restrictions and Transfer of Risk
5.1 Delivery is made to the delivery address specified by the customer, provided that the respective delivery country is selectable in the online shop or delivery has been agreed in individual cases.
5.2 Any delivery restrictions are shown in the online shop, in the offer, in the shopping cart or during checkout.
5.3 The delivery time is stated in the respective product description, offer or checkout information. In the case of prepayment, the delivery period begins after receipt of payment.
5.4 For consumers, we bear the shipping risk. For entrepreneurs / business customers, the risk of accidental loss and accidental deterioration of the goods passes to the customer as soon as the goods are handed over to the logistics provider.
5.5 For freight goods, coordination of delivery by phone or in writing may be required.
6. Retention of Title
6.1 The delivered goods remain our property until payment has been made in full.
6.2 In relation to entrepreneurs / business customers, we retain title to the goods until all claims arising from the ongoing business relationship have been paid in full.
7. Notes on Vehicle Parts, Installation, Approval and Road Use
7.1 Many of the items we offer are spare parts, accessories or off-road components for vehicles. The customer is responsible for checking before installation whether the item is suitable for their vehicle, intended use and applicable approval situation.
7.2 Where a part certificate, general operating permit, E-mark, individual approval or other technical approval is required for an item, admissibility depends on the applicable legal requirements and the specific vehicle configuration.
7.3 Safety-relevant vehicle parts should be installed professionally and, where necessary, by a qualified specialist workshop.
7.4 Notes in product descriptions, certificates or manufacturer information must be observed.
8. Right of Withdrawal for Consumers
8.1 Consumers have the statutory right of withdrawal. The statutory right of withdrawal applies exclusively to consumers within the meaning of Section 13 BGB. Entrepreneurs / business customers within the meaning of Section 14 BGB who place an order in the course of their commercial or independent professional activity do not have a statutory right of withdrawal.
8.2 Any return of goods ordered by entrepreneurs / business customers requires our prior express approval and is a voluntary goodwill service. Statutory rights for defects remain unaffected.

Please do not send goods to our head office in Ludwigsburg. Goods receipt and returns processing are handled by EMO-LOG in Münster.
Withdrawal Policy for Consumers
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods.
To exercise your right of withdrawal, you must inform us by means of a clear statement, for example by letter or email, of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send the notice of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us, without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal from this contract.
For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods without undue delay and in any event no later than 14 days from the day on which you inform us of the withdrawal from this contract to our return address.

The deadline is met if you send the goods before the period of 14 days has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way that was not necessary to establish their nature, characteristics and functioning.

9. Notes on Returns
9.1 Please avoid damage and contamination of the goods. If possible, return the goods in the original packaging with all accessories and packaging components.
9.2 Use of the original packaging is not a prerequisite for effectively exercising the right of withdrawal.
9.3 If possible, please include a copy of the invoice, the order number or a short note with your name so that we can assign and process the return more quickly.

10. Statutory Liability for Defects, Warranty and Liability
10.1 All goods are subject to the statutory liability for defects.
10.2 For used goods, the warranty period towards consumers may be reduced to 12 months if this is expressly stated in the respective offer and is legally permissible.
10.3 In relation to entrepreneurs / business customers, the warranty period for new goods is one year from transfer of risk, unless mandatory statutory provisions provide otherwise.
10.4 Statutory claims for injury to life, body or health, intentional or grossly negligent breach of duty and claims under the German Product Liability Act remain unaffected.
10.5 Any manufacturer warranties or dealer warranties do not restrict the customer's statutory rights.
11. Warranty Conditions
11.1 If a warranty is expressly stated in the respective product description, the warranty conditions stated there apply.
11.2 If we, 4 Wheel Parts GmbH, grant our own dealer warranty, this covers material and manufacturing defects within the stated warranty period, unless otherwise specified.
11.3 In the event of a warranty claim, please send us a description of the problem, proof of purchase and meaningful photos or evidence. Depending on the case, return of the goods may be required.
11.4 The warranty supplements your statutory rights and does not restrict them.
12. Consumer Information for Distance Contracts
12.1 The essential characteristics of the goods are set out in the respective product description.
12.2 The contract language is German.
12.3 We do not permanently store the contract text online for the customer to access. However, after placing the order, the customer receives an order confirmation or contractual information by email.
12.4 For orders placed via eBay, storage and retrievability of the contract text are additionally governed by the respective eBay functions.
12.5 Complaints, claims and warranty requests may be sent to the contact address stated in the legal notice or in these Terms and Conditions.
12.6 There are no special codes of conduct beyond these Terms and Conditions.
13. Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Note: The former EU Online Dispute Resolution platform has been discontinued. Therefore, no corresponding ODR platform link is used.

15. Final Provisions
15.1 German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has their habitual residence.
15.2 If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office shall be the place of jurisdiction, insofar as legally permissible.
15.3 Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
